ICAN ISSUES LEGAL DEMAND TO MDHHS REGARDING ITS ILLEGAL PROCESS FOR OBTAINING NONMEDICAL VACCINE EXEMPTIONS
TROY, MI ~ Informed Consent Action Network (ICAN) issued a demand letter to the Michigan Department of Health and Human Services (MDHHS) regarding the agency’s illegal overreach concerning nonmedical vaccine exemptions for school-aged children.
ICAN’s letter detailed the many legal infractions that MDHHS is conducting when processing a parent’s request for nonmedical exemption, including entering the child’s waiver information in the state’s vaccine tracking system and denying parents access to their information.
Despite the detailed allegations outlined in the letter, MDHHS’s response was dismissive of the substantial and well-supported allegations. However, MDHHS claimed it would inquire about local health department practices.
MDHHS has a history of violating state and federal law regarding how vaccine exemptions are obtained, stored, and shared. Michigan for Vaccine Choice’s (MVC) 2018 letter to school districts led to a quiet admission of MDHHS’s unlawful access to files protected under FERPA, resulting in a corrective procedure. Additionally, MVC sent a letter to MDHHS calling on them to end unconstitutional vaccine mandates in the workplace.
It is unacceptable for a bureaucratic agency, like MDHHS, with broad powers to promulgate rules, to violate federal and state laws, and to summarily dismiss demand letters detailing grievous violations of law. Michigan For Vaccine Choice will remain vigilant in tracking this issue. It will take action as appropriate to ensure that elected officials, school districts, parents, and tax payers are aware of these violations.
